Palikot i spółka ukarani. Ponad milion złotych grzywny
Urząd Ochrony Konkurencji i Konsumentów zdecydował o nałożeniu ponad miliona złotych kary na Janusza Palikota oraz spółkę Polskie Destylarnie. Chodzi m.in. o kampanię „Skarbiec Palikota”, w ramach której biznesmen zbierał fundusze, ale już po kilku tygodniach przestał spłacać odsetki klientom.
Postępowanie zostało wszczęte na początku lutego 2024 roku. Już wówczas UOKiK zakwestionował praktyki biznesowe Janusza Palikota i spółki Polskie Destylarnie z Lublina, która organizowała kampanię pożyczkową „Skarbiec Palikota”.
UOKiK: Palikot wprowadzał w błąd
„Prezes UOKiK Tomasz Chróstny w prowadzonym postępowaniu postawił spółce Polskie Destylarnie 6 zarzutów naruszenia zbiorowych interesów konsumentów. Ustalił również odpowiedzialność Janusza Palikota, członka zarządu tej spółki, za przyczynienie się do naruszenia prawa” – przekazał we wtorek UOKiK.
Uznano m.in., że informacje promocyjne na stronie internetowej Polskich Destylarni oraz w mediach społecznościowych Palikota wprowadzały odbiorców w błąd. Podawano tam m.in., że firma jest „czołowym polskim producentem alkoholu etylowego”, choć mijało się to z prawdą.
„Jak ustalił UOKiK w toku postępowania, obrót Polskich Destylarni wyniósł w 2022 roku 0 zł” – wskazuje urząd, choć spółka chwaliła się zyskami idącymi w dziesiątki miliony złotych.
Crowfunding pożyczkowy” bez nadzoru
Kolejny zarzut dotyczył „finansowania społecznościowego” i „crowfundingu pożyczkowego”, które były podstawą kampanii reklamowej „Skarbca Palikota”. Tymczasem formalnie zbiórka nie podlegała tzw. ustawie crowfundingowej, przez co konsument nie był objęty ustawową ochroną
Pieniądze wpłacane przez klientów były przeznaczane – opisuje UOKiK – na pokrycie bieżących długów Polskich Destylarni. Środki lądowały także w innych podmiotach powiązanych z Januszem Palikotem.
Rolls-Royce, którego nie było
Ostatni zarzut dotyczy fikcyjnego konkursu, którym reklamowano „Skarbiec Palikota”. Wśród klientów miały zostać rozlosowane wycieczki do Nowego Jorku, Paryża czy Marrakeszu, a także luksusowy samochód Rolls-Royce. Nie wyłoniono jednak żadnego zwycięzcy, żadna nagroda nie została przyznana.
Na Janusza Palikota (jako członka zarządu Polskich Destylarni) nałożono karę za umyślne naruszenie praw konsumentów – 950 tys. złotych. Spółkę z kolei obciążono grzywną w wysokości 239 tys. Zł.
