Uzasadnienie postanawia ws. zajęcia Komorniczego
Dnia 27 kwietnia 2023 r. Komornik Sądowy przy Sądzie Rejonowym Lublin-Zachód w Lublinie złożył postanowienie z dnia 26 kwietnia 2023 r., sygn. akt Km 2300/22 o umorzeniu egzekucji z praw majątkowych – akcji przysługujących dłużnikowi “PIWOWARZY”S.A. w MANUFAKTURA PIWA WÓDKI I WINA SPÓŁCE AKCYJNEJ z siedzibą w Tenczynku.
Zgodnie z art. 911{3} k.p.c. zajmując udział wspólnika w spółce handlowej albo prawa wspólnika z tytułu udziału w takiej spółce, którymi wspólnikowi wolno rozporządzać, jak również prawa majątkowe akcjonariusza, komornik powiadomi o zajęciu spółkę oraz zgłosi ten fakt sądowi rejestrowemu.
Postanowieniem tut. Sądu z dnia 22 września 2022 r. sygn. akt KR XII Ns Rej KRS 15276/22/225 dołączono do akt zawiadomienia Komornika Sądowego przy Sądzie Rejonowym Lublin-Zachód w Lublinie z dnia 07 września 2022 r., sygn. akt Km 2300/22 o zajęciu udziałów dłużnika “PIWOWARZY”S.A. w MANUFAKTURA PIWA WÓDKI I WINA SPÓŁCE AKCYJNEJ z siedzibą w Tenczynku w postępowaniu egzekucyjnym.
Mając powyższe na względzie, należało dołączyć do akt informację o umorzeniu postępowania w toku, którego zostały zajęte udziały, wobec czego orzeczono jak w sentencji.
